Are your returns policies compliant with the Australian Consumer Law?
In November last year, the ACCC announced that it will be cracking down on clothing retailers, particularly those trading online, to review their returns policies to ensure compliance with the Australian Consumer Law.
I’ve reviewed more returns policies than I can count and have noticed that it is often the case that retailers use vague language in their policies which can sometimes mislead customers about their rights. It is essential that you ensure your returns policy does not purport to exclude the rights of the consumer to choose their remedy in the case of a major fault, exclude returns for faulty goods or limit the period of time in which a consumer may return a good (without clarifying that a further warranty period may be applicable).
