Online retailers have the benefit of being able to provide a range of goods without need for a physical shop front. It is is easy to assume that the Australian Consumer Law may be unenforceable against online retailers as a result, however it is not.
The ACCC has shown that online retailers cannot escape their obligations after issuing online retailer, Update Technology Pty Ltd (‘Update Technology’), with a $10,200 penalty for failing to ensure that its high lift jacks were compliant with the relevant mandatory safety standards.
An infringement notice may be issued where the ACCC has reasonable grounds to believe that consumer protection laws have been contravened. The ACCC purchased and tested a high lift jack from Update Technology. The tests showed that the product did not meet safety performance requirements and did not have the required labelling contrary to mandatory standards.
