New Year Legal Checklist for Retailers

Want to start the new year on the best foot?  We recommend spending some time to check off the following list to make sure everything is in order for the new year.

  1. Review your existing contracts
    Now is the perfect time to review your business’ existing contracts, such as your leases, distribution and supply arrangements to make sure that you have diarised all of the termination or expiry dates.  Make note about whether you are happy with your contracts and if any issues have arisen.  If the contracts are coming up for renewal or expiry soon, consider reviewing and negotiating their terms.If you need to renew or vary any of your agreements call us and we can help you through this process.
  1. Plan your marketing timeline for 2019 (it may have legal requirements)
    It is a great idea to get a broad overview of your campaign for the next year to ensure that you have ample time to get formalities sorted.  For example, highlight key dates such as around the Easter season where you may want to run a competition and give yourself at least 3-4 weeks in advance to draft your T&Cs and obtain relevant permits.  We can assist with this entire process – feel free to send us your expected competitions/marketing calendar and we’ll check if there are any legal requirements and also diarise and follow up everything for you!   2. Review and update your website and retail terms
    It is easy to forget to update your retail terms, such as your returns, shipping/delivery and gift card policy, but as they outline your processes it is essential to keep them up to date and compliant with law (particularly Australian Consumer Law).  We also highly recommend reviewing your website and shopping terms and conditions and privacy policy – it is a requirement under the Australian Privacy Principles that your privacy policy is accurate and up to date.  Feel free to send them to us and we will let you know whether they need an update.
