As we recently noted in our update on retail leases article, it is mandatory for landlords to provide rent relief to tenants of commercial and retail premises in proportion with their loss of turnover, pursuant to the Federal Government’s Mandatory Code of Conduct for SME commercial leases (Code).
The eligibility requirements include that the tenant must be eligible for the JobKeeper Payment subsidy and have less than $1 billion turnover. Each State will need to pass legislation reflecting the principles set out in the Code, however we recommend that tenants commence discussions with their landlords as soon as possible.
We have prepared a template rent relief application for eligible tenants, which can be completed and sent to landlords preemptively.
